Abdul Hameed V. Mst. Shabnam Alias Shabana and 2 others,

PLD 2014 Balochistan 39 · Balochistan High Court

This case is about which court should hear an appeal in a child custody dispute. A mother, Mst. Shabnam, had applied under the Guardians and Wards Act, 1890, for custody of a minor, and the Family Judge at Hub granted her custody. The father, Abdul Hameed, appealed to the Additional District Judge, but that judge dismissed the appeal, saying he had no jurisdiction and that such appeals should instead go directly to the High Court, based on Section 47 of the Guardians and Wards Act.

The Balochistan High Court disagreed. It explained that custody and guardianship matters cannot be decided by looking at the Guardians and Wards Act alone; they must be read together with the West Pakistan Family Courts Act, 1964, which gives Family Courts exclusive jurisdiction over such matters. Under this combined reading, appeals from a Family Court's custody decision normally go to the District Court, unless the Family Court itself was presided over by a judge of District Judge rank, in which case the appeal would go to the High Court. Since the case had been decided by a Family Judge without that status, the appeal should have gone to the District Judge, not the High Court.

The High Court found that the Additional District Judge had made an error and wrongly refused to hear the appeal. It set aside that order and directed the appellate court to decide the appeal on its merits. This clarifies the correct appellate path for custody cases decided by Family Courts.
