Muhammad Akram Baloch V. Akbar Askani and others,

PLD 2014 Balochistan 28 · Balochistan High Court

This case involved a dispute over the 2013 general election result for a Provincial Assembly seat (PB-50 Kech-III) in Balochistan. The losing candidate, Muhammad Akram Baloch, filed an election petition alleging that the declared winner, Akbar Askani, won through massive rigging and illegal practices, allegedly with help from the district administration. Specifically, he claimed that at two polling stations no actual voting took place and no election staff were present, meaning the results there were fabricated.

To prove this, the petitioner asked the Election Tribunal to send the counterfoils (vote stubs) from those polling stations, along with the voter lists, to NADRA for scientific verification of thumbprints, to check whether real voters had actually cast those votes or whether impersonation occurred.

The Tribunal ruled in favor of allowing this verification. It held that while ballot secrecy is important and inspection of ballots should not be allowed routinely, courts can use modern technology like NADRA's biometric data as evidence when serious, specific allegations of rigging are made. It found that a voter's right to ballot secrecy is not absolute and can be waived to ensure fair elections. The Tribunal allowed the NADRA verification report to be produced as evidence, with both sides free to raise objections to it.

This case matters because it shows courts using modern technology to investigate serious election fraud claims while balancing it against the constitutional principle of ballot secrecy.
