Ashfaque Ahmed and 4 others V. National Accountability Bureau through Chairman and 3 others,

PLD 2014 Balochistan 109 · Balochistan High Court

This case involved civil servants who had been penalized departmentally for embezzlement. They appealed to the Balochistan Service Tribunal, which upheld findings against them and directed that the matter be referred to the National Accountability Bureau for action. Based on this direction, NAB investigated and filed a corruption reference against them before the Accountability Court. The petitioners later challenged the Tribunal's order before the Supreme Court, which sent the matter back for fresh departmental inquiry. Separately, they asked the Accountability Court to drop the NAB case, arguing that under the National Accountability Bureau Ordinance, only the NAB Chairman could initiate proceedings, and that acting merely on a Tribunal's direction made the reference invalid. When the trial court rejected this argument, they approached the High Court.

The High Court dismissed their petition. It held that NAB can lawfully start proceedings whenever it learns of an offence from any source, including a court or tribunal judgment, a government reference, or a complaint. Such information from a Tribunal's order can be treated as a complaint, and the NAB Chairman still exercises independent judgment before sanctioning investigation and filing the reference. Since the Chairman did examine the material and found sufficient evidence before filing the reference, the proceedings were valid and not "coram non judice." This matters because it clarifies that NAB's power to act is not limited to formal government references or complaints but extends to any credible source of information, including judicial findings.
