Qamar Gill v. Iram Nathaniel,

PLD 2013 Qta 59 · Balochistan High Court

This case involved a Christian couple whose marriage broke down. The wife, Iram Nathaniel, filed a suit seeking maintenance (alimony) for herself and her minor son against her husband, Qamar Gill, after she alleged she was thrown out of the house without proper support. The trial court in Quetta ruled in her favor, awarding monthly maintenance for both her and the child. On appeal, the amount was slightly adjusted but the core decision upheld.

The husband challenged these rulings before the Balochistan High Court, arguing that the trial court lacked jurisdiction to hear the case and that the lower courts had not properly weighed the evidence, including limits on alimony under the Christian Divorce Act, 1869.

The High Court dismissed the husband's petition. It held that he had never raised the jurisdiction objection in his original written statement, so he could not raise it for the first time later. It also found that, under the Divorce Act, 1869, a case like this could indeed be tried by a civil court where the spouses had resided together, which applied here. The court also upheld the maintenance amounts fixed by the lower courts as being properly calculated in line with the law's requirements.

This case matters because it clarifies how maintenance disputes among Pakistan's Christian community are handled under the Divorce Act, 1869, and reinforces the principle that legal objections not raised early in a case cannot be introduced later during appeals.
