PLD 2013 Balochistan 62 · Balochistan High Court
This case involved a dispute between landlords and tenants over eviction proceedings in Loralai, in Balochistan's tribal areas. Eviction applications had been filed under an old colonial-era law called the British Balochistan Rent Control Regulation of 1945, and the trial court allowed the evictions, rejecting the tenants' objection that this old law no longer applied.
The tenants challenged this before the Balochistan High Court, arguing the 1945 Regulation had been superseded by the West Pakistan Urban Rent Restriction Ordinance, 1959. The landlords and the government countered that since the 1959 Ordinance had never been formally extended to tribal areas, the old 1945 Regulation must still govern those areas.
The High Court traced the history of the law and found that the 1945 Regulation was tied to the office of the Chief Commissioner and to courts that existed under British Balochistan administration, both of which had ceased to exist after Pakistan's creation and the formation of Balochistan province. With no one left with authority to apply or administer it, the Regulation had effectively become defunct. The court also noted the courts currently handling such cases were not properly empowered to hear rent matters under this obsolete law, making the earlier proceedings legally void.
The court ruled that no court could proceed under the 1945 Regulation anymore, allowed the petitions, and directed the provincial government to extend the 1959 Ordinance to tribal areas within thirty days, so residents there would have a proper legal mechanism for rent disputes.
