PLD 2013 Balochistan 144 · Balochistan High Court

This case involved a man convicted of murder (qatl-e-amd) and sentenced to death by a Sessions Court in Turbat, Balochistan. He appealed to the Balochistan High Court seeking acquittal. During the appeal, the family of the victim agreed to pardon him and filed a compromise application, waiving their right to demand qisas (retaliatory punishment equivalent to the death penalty) without asking for any diyat (compensation).

The High Court examined this compromise carefully because two of the nine legal heirs were minors (aged 14 and 17), and their mother tried to waive their right to qisas on their behalf without accepting any compensation. The court ruled this was not legally valid. Under Pakistani law, a minor's guardian cannot simply forgive the right to qisas for free; the law only allows the guardian to "compound" that right by accepting badal-e-sulh (compensation), which must be worth at least as much as the diyat (blood money) amount.

The court held that a valid compromise regarding minors requires a determined and accepted compensation amount, not a free pardon. It fixed badal-e-sulh at Rs. 32,00,000, to be deposited in National Savings accounts for the minors until they reach adulthood. The accused was acquitted of the murder charge under section 302(b) but would remain in custody until this amount was paid. The case clarifies that courts, not just guardians, must ensure minors' financial interests are protected in murder compromises.
