This case is about a shooting that took place at a fruit shop in Hub, Balochistan, on 14 April 2010. According to the complainant, an argument over Rs. 20 change escalated when the accused, Saleh Muhammad alias Hashim Marri, left the shop threatening revenge, then returned about 20-25 minutes later with two armed companions and opened fire on the shopkeeper and others present. Two people, the complainant's cousin and brother, were killed, and three others were injured. Police registered an FIR shortly after the incident and recovered a pistol from the accused at the scene.
The trial court convicted Saleh Muhammad under Section 302(b) of the Pakistan Penal Code (murder) and sentenced him to death. He appealed to the Balochistan High Court, and the case also came up for confirmation of the death sentence.
The High Court upheld the conviction and confirmed the death sentence. It found the FIR was lodged promptly, the eyewitness account matched the medical evidence, the motive (the argument over money) was credible, and the recovered weapon was forensically linked to the crime. The court also clarified important legal principles: a single witness's testimony can be enough for conviction if trustworthy; being related to the victim doesn't automatically make a witness unreliable; and failure to recover bullet casings or weak motive evidence doesn't necessarily undermine an otherwise solid prosecution case. The appeal was dismissed, and the death sentence stood confirmed.

ٹرائل کورٹ نے صالح محمد کو پاکستان پینل کوڈ کی دفعہ 302(بی) کے تحت قتل کا مجرم قرار دیتے ہوئے سزائے موت سنائی۔ اس نے بلوچستان ہائی کورٹ میں اپیل دائر کی، اور یہ مقدمہ سزائے موت کی توثیق کے لیے بھی ہائی کورٹ کے سامنے پیش ہوا۔
