Asmatullah Khan v. Government of Balochistan,
PLD 2013 Balochistan 12 · Balochistan High Court
This case involved a man, Asmatullah Khan, who asked the Balochistan High Court to declare him head (sardar) of the Miankhail tribe and order the government to include him as a member of the Local Committee in Zhob district. He argued that without such recognition, members of his tribe faced difficulties obtaining local residency certificates, since these were issued based on Local Committee recommendations. He relied on certificates from local officials calling him "Sardar" and a government letter recognizing the Miankhail tribe as indigenous to the area.
The High Court dismissed the petition. It held that Pakistan's Constitution guarantees equality of all citizens under Article 25, and does not recognize anyone as superior due to titles like sardar, nawab, or malik. It noted that the "sardari" system was formally abolished by Parliament through the System of Sardari (Abolition) Act, 1976, and that Article 33 requires the state to discourage tribal and parochial prejudices. The court also explained that under Article 8, any custom inconsistent with fundamental rights is void, meaning claims to sardar status could not be enforced if they conflicted with equality principles. Finally, the court found the petitioner was not "aggrieved" as required by Article 199, since he wasn't denied legal protection or unequal treatment under the law.
This case matters because it reaffirms that Pakistan's constitutional framework does not permit special privileges based on tribal titles, reinforcing equal citizenship regardless of tribal hierarchy.
