Muhammad Saleem Khan v. Gov. of Pakistan,

PLD 2013 Balochistan 10 · Balochistan High Court

This case involved a government official, Muhammad Saleem Khan, who had been nominated by Balochistan's provincial administration to perform Hajj duty as part of a seasonal government staffing arrangement for 2012, with the Provincial Government agreeing to pay for his and other officials' Hajj expenses. The federal Ministry of Religious Affairs refused to accept the payment cheque, stating that the 2012 Hajj Policy contained no provision for Hajj to be performed at government expense, and citing a Supreme Court order which had said that no one may use government money without legal justification.

The petitioner argued that the Supreme Court order was only an interim order (not a final judgment) and did not actually prohibit performing Hajj at government cost, and sought a court direction ordering the Ministry to send him and other nominees for Hajj duty.

The Balochistan High Court dismissed the petition. It held that even though the Supreme Court's order was interim, it could not be disregarded, since Article 189 of the Constitution makes Supreme Court rulings on points of law binding on all other courts. The Ministry had correctly relied on the principle that public money cannot be spent without legal justification, and no law existed requiring government-funded Hajj trips. The court also noted the petitioner failed to identify any fundamental right being violated, so he was not an "aggrieved person" entitled to file such a petition. The court added that Hajj is religiously obligatory only for those who can personally afford it, not something owed at public expense.
