Muhammad Abdullah v. Gov. of Pakistan,

PLD 2013 Balochistan 1 · Balochistan High Court

This case comes from the Balochistan High Court, where a routine constitutional petition against the federal government could not be heard on 1 October 2012 because no government lawyer showed up. The reason, revealed in a press statement, was that federal law officers across Pakistan had boycotted court proceedings that day in protest against an order passed by a judge of the Supreme Court, apparently over a personal grievance of the Attorney General.

The High Court sought explanations from the Attorney General, the Deputy Attorney General, and two Standing Counsel who had failed to appear. Their responses did not express regret but instead tried to justify the boycott, comparing it to past lawyers' strikes. The court rejected this comparison, holding that private lawyers protesting constitutional violations (such as judges being sacked by a dictator) is entirely different from state-paid law officers abandoning their duties over an individual's personal complaint. The court held that such intentional non-appearance obstructed judicial proceedings, violated the officers' statutory duties, wasted public money, and inconvenienced litigants.

Taking a lenient view since it was a first such incident, and acknowledging the officers may have felt pressured to show solidarity, the court ordered that one day's salary be deducted from the Deputy Attorney General and Standing Counsel who did not work that day, and recommended that other law officers across Pakistan who joined the boycott be treated similarly. The case underscores that public officials, especially law officers, are accountable to the public and cannot use strikes to settle personal grievances at the cost of justice.
