Rehmatullah & others v. Hameedullah & others,

PLD 2013 52 · Balochistan High Court

This case from the Balochistan High Court involved a long-running land and water dispute over property in Mouza "Narai Dag" near Loralai. The respondents had sued the petitioners, claiming their ancestors were co-sharers of the land and "lathband bazgars" (tenants) of the Provincial Government, and accused the petitioners of interfering with an irrigation water channel. A trial court (Qazi Bori/Sanjavi) ruled in the respondents' favor, and this was upheld on appeal. Later, when the petitioners allegedly violated that decree by using a tractor on the land, contempt proceedings followed, leading to further appeals and multiple connected petitions being heard together.

The High Court found a fundamental legal flaw: the disputed land actually belonged to the Provincial Government, yet the government was never made a party to the original suit, as required by law when government property is involved. Because of this, the original decree was declared void, and the court dismissed the suit, though it allowed the respondents to file a fresh case if they wished.

Since the contempt proceedings were based on that invalid decree, they too were set aside. The court also noted that only the High Court or Supreme Court have authority to convict someone of contempt—not a trial court—making those contempt convictions unlawful as well.

This case highlights the importance of including the government as a party in disputes over public land and clarifies which courts have power to punish contempt.
