Chamber of Commerce and Industry v. Balochistan Director - General, QDA,
PLD 2012 Balochistan 31 · Balochistan High Court
This case from the Balochistan High Court concerned a public park in Quetta, built on the site of the old General Bus Stand, which had been named after the sitting Prime Minister. The Quetta Development Authority (QDA) planned to allot land around three sides of the park to build shops, with living quarters or upper floors that would overlook the park with no buffer distance. A chamber of commerce and, separately, a group of shopkeepers challenged this scheme.
The court held that the petitions were maintainable as public interest litigation, even without the petitioners being directly "aggrieved," because parks and similar public resources are held in trust for everyone. It found that surrounding the park with shops offering an unobstructed view into it would violate fundamental rights, including the right to dignity and limited privacy in public spaces, and would discourage women, families, and the poor and unemployed—who rely most on public parks—from using it. It also found that naming a public park after a living, sitting official was improper, amounting to self-promotion and misuse of official power.
The court ordered that no land be allotted or shops built around the park, that money already collected from prospective shop allottees be refunded, that the park's plaque and name honoring the living official be removed, and that the park be preserved permanently for public recreational use, with compliance reported to the court.
This judgment matters because it affirms that public spaces and natural resources belong to all citizens, restricts official misuse of power for self-glorification, and strengthens fundamental rights protections in the context of urban planning and public trust doctrine.
