Nasreen Khetran v. Government of Balochistan,
PLD 2012 Balochistan 214 · Balochistan High Court
Nasreen Khetran, a member of the Balochistan Provincial Assembly and provincial minister, challenged a 2009 government order creating 1500 new Junior Vernacular Teacher posts across Balochistan, complaining that her constituency, District Barkhan, received only 15 of these new posts. She argued this was unfair given the district's population and needs, and later also alleged schools in the area were closed or misused.
The government responded that Barkhan actually had a favorable teacher-student ratio (better than the recommended standard), already had 845 sanctioned teaching posts, and that the new posts were distributed based on need, not equally across districts. Court-ordered investigations by local officials found the schools were functioning properly and none were being misused, contradicting the petitioner's additional claims.
The Balochistan High Court noted that the petitioner, despite being an elected representative and minister, had to resort to litigation simply to get basic information about government performance and resource allocation. The judges emphasized that citizens and their representatives have a right to know how public money is spent and how government departments are performing, and that transparency laws already exist (like Pakistan's and Balochistan's Freedom of Information laws, and the constitutional right to information under Article 19A) to ensure this. The case highlights how lack of accessible public information can lead to unnecessary disputes and underscores the importance of transparency in government functioning.
