Abdul Malik v. Metropolitan Corporation,

PLD 2012 Balochistan 208 · Balochistan High Court

This case is about how public property in Quetta should be leased out. A government contractor challenged the way the Metropolitan Corporation Quetta (which took over from Zarghoon Town) had handed over the right to collect parking fees at Baldia Plaza. Instead of publicly advertising the contract and awarding it to the highest bidder, the Corporation appeared to have given it to another party through an agreement that was never properly verified, was not routed through the correct department, and whose signatory later denied signing it. That contractor also owed a large sum of money to the Corporation, and the Chief Minister had purportedly waived part of this debt.

The High Court found that no tender or public bidding process had been followed before granting the parking collection rights, which was legally required. It also held that there was no law allowing the Chief Minister to waive public dues owed to the Corporation, and that public money must be carefully protected and cannot simply be forgiven by executive discretion. As a statutory body, the Corporation had to follow its own rules.

The Court allowed the petition and directed the Corporation to immediately invite open bids for the parking fee collection rights and award the contract to the highest bidder. The judgment matters because it reinforces transparency and accountability in how local governments handle public assets and revenue, preventing informal or favoritism-based deals at the public's expense.
