This case concerns the illegal arrest and transfer of a citizen based on a complaint that did not even accuse him of any wrongdoing.
Syed Shamsuddin was named only in the title of a complaint filed in Kohat (a tribal area) accusing his brother of failing to repay a business loan given in Dubai. Despite no allegations against Shamsuddin himself in the body of the complaint, the Assistant Political Agent of Kohat sought his arrest, and officials in Balochistan handed him over without following the mandatory legal procedure under Section 86-A of the Criminal Procedure Code, which requires a person to be produced before a magistrate before being transferred across jurisdictions. He was taken to Kohat and imprisoned before eventually securing bail.
Shamsuddin challenged this action in the Balochistan High Court. The government side argued that courts had no jurisdiction because the matter involved a Tribal Area, which is normally excluded from ordinary court oversight under the Constitution.
The Court rejected this argument, holding that since the loan dispute arose in Dubai, not within any Tribal Area, the exclusion of jurisdiction did not apply. The Court found that officials in both Khyber Pakhtunkhwa and Balochistan had abused their authority, effectively acting as tools for a private complainant to harass someone, and that the whole process was patently unlawful. It ordered that no further action be taken against Shamsuddin over this complaint and directed the federal government, provincial government, and the complainant to each pay him compens
