Muhammad Anwar Jaffar v. Govt. of Balochistan,

PLD 2012 Balochistan 186 · Balochistan High Court

This case involved a group of tribesmen from Tehsil Drug in Balochistan who claimed to be the rightful owners of land their ancestors had lived on for four to five hundred years. They objected to the government and a private company carrying out oil and gas exploration surveys on this land, arguing that under the Land Acquisition Act, 1894, such surveys could not proceed without following legal procedures and paying compensation. They asked the Balochistan High Court to stop the exploration activities.

The court dismissed the petition. It found that the petitioners had failed to attach any actual order or notification showing that exploration had even taken place, despite being specifically asked to provide such documents years earlier. The only real evidence was a letter from the lead petitioner, styled as a tribal chief, asking a private company to negotiate with a tribal council rather than objecting to the exploration itself. The court noted this reliance on tribal chieftainship was questionable given that the System of Sardari (Abolition) Act, 1976 had formally abolished such tribal structures. The court also held that the petitioners had not proven their ownership of the land, that this was a disputed factual question unsuitable for resolution under constitutional jurisdiction, and that they were not "aggrieved persons" entitled to relief under Article 199. Instead, they had other legal remedies available to establish title and contest any encroachment. This case highlights the limits of constitutional petitions for resolving property disputes.
