Students of Government Girls College Kuchlak v. Government of Balochistan,
PLD 2012 Balochistan 168 · Balochistan High Court
This case began when the Balochistan High Court took suo motu (on its own initiative) notice of a newspaper report saying that influential persons were encroaching on land set aside for the Government Girls College at Kuchlak. The court treated the news report as effectively a petition from the girls of the area who had no other practical way to seek legal help, and used its constitutional powers to investigate.
The land, about 14 acres, had been leased by the Balochistan government to the Education Department for 99 years specifically to build the college. Records showed a lawsuit by private individuals claiming ownership had already been dismissed by a civil court. Despite this, local officials had recommended giving part of the land to other individuals, and residents had illegally built a road cutting through the property without permission. The court found none of this created any legal right for those involved, since the land clearly belonged to the Education Department.
The court ruled that failing to protect this land would deprive girl students of a school built with public money, calling this a violation of their fundamental rights to education and equal treatment under the Constitution. It ordered the Education Department to repossess the entire plot, build a boundary wall to prevent further encroachment, and directed police to assist if anyone interfered.
The case matters because it shows courts actively protecting public resources meant for girls' education, especially in an underserved region, even when the affected people themselves could not easily approach the courts.
