Ikramullah v. State,

PLD 2012 Balochistan 16 · Balochistan High Court

This case involved several people caught illegally possessing and transporting 190 cranes, a protected bird species under Balochistan's Wildlife Protection Act, 1974. After they pleaded guilty, a Magistrate fined each accused only Rs.1,000 and let them keep the birds. The Executive District Officer for Forest and Wildlife challenged this, and the Sessions Judge ordered the birds be seized and handed back to wildlife authorities. By the time the case reached the Balochistan High Court, however, all 190 cranes had died from a viral infection, making the seizure order impossible to enforce.

The Chief Justice found that the original fine was inadequate because the Magistrate had fined each person a flat Rs.1,000 regardless of how many birds they held, when the law actually treats possession of each bird as a separate offense. The court noted that Rs.1,000 was set as a maximum fine back in 1974 and had lost real value over 37 years, making it too weak a deterrent. Since the birds had died, the court imposed a fresh fine under a different section of the Act, calculated at Rs.500 per bird, totaling Rs.95,000, which the accused paid.

This judgment matters because it reinforces that wildlife protection laws must be enforced meaningfully, with penalties matching the scale of the offense, and it treats the killing or illegal capture of protected species as a serious matter deserving real consequences rather than token fines.
