Muhammad Jamil v State,
PLD 2012 Balochistan 140 · Balochistan High Court
This case is about two employees of a pharmaceutical company, Messrs Chas-A Mendoza, who were prosecuted under Pakistan's Drugs Act, 1976 for allegedly manufacturing and supplying a misbranded and substandard medicine capsule called Ronuvit. A drug sample was tested by the Central Drug Laboratory, which found it substandard, and the company received sanction for prosecution. However, only two employees—the Quality Control Incharge and the Warrantor—were charged, while the company itself was never prosecuted.
The employees sought acquittal before the trial court, which was rejected, prompting them to approach the Balochistan High Court to quash the proceedings entirely.
The High Court ruled in favor of the employees. It held that without first prosecuting the company itself, its employees could not be held liable under the Drugs Act. The court also found serious procedural flaws: the lab report was submitted nine months late instead of within the required sixty days, the report failed to disclose the testing method used as legally required, and the trial court's order was passed only by the Chairman without the required two additional Members, making it improperly constituted. The order was also non-speaking, meaning it failed to address the arguments raised.
Given these violations, the court concluded there was no chance of conviction even if the trial continued, so it quashed the proceedings and acquitted the accused. This case highlights how strict procedural compliance and proper legal targeting of responsible parties are essential in drug law prosecutions.
