Abdul Malik v. Government of Pakistan,

PLD 2012 Balochistan 11 · Balochistan High Court

Two Ministers of the Balochistan government and two Senators went to the Balochistan High Court asking it to stop the national census being carried out in the province under the Census Ordinance, 1959. Their main arguments were that a large number of Afghan refugees were living in Balochistan, that law and order in the province was poor, and that some populations had migrated due to conflict or floods, making conditions unsuitable for an accurate census.

The High Court, led by Chief Justice Qazi Faez Isa, rejected these arguments. It noted that six general elections had already been held in Pakistan since the Afghan refugee influx began, without this issue being raised, and that refugee numbers had actually decreased over time compared to previous censuses in 1981 and 1998. The court pointed out that maintaining law and order was the government's own responsibility, and since two petitioners were sitting ministers, their plea effectively amounted to admitting their own government's failure. The court also observed that an accurate census could benefit Balochistan by increasing its representation in the National Assembly, since seats are allocated based on population. It held that deciding when to hold a census is a political decision for the Federal Government, not something courts should interfere with.

The petition was dismissed. The case matters because it reaffirms that courts will generally not intervene in political and administrative decisions like census-taking, and clarifies that census data serves broader planning purposes for governments at all levels.
