Obaidullah v. Mir Muhammad Ali Rind,
PLD 2012 Balochistan 1 · Balochistan High Court
This case is about whether Senator Mir Muhammad Ali Rind was legally qualified to hold his Senate seat, given that he had earlier been convicted of corruption. In 2000, an Accountability Court found him guilty in two corruption references and disqualified him from holding public office for 21 years. He later struck a plea bargain, paying back the embezzled amounts, and this reduced his disqualification period to ten years, running from June 2001. Despite this, in 2009 he submitted nomination papers for a Senate seat and was elected, without disclosing his prior conviction, and while his ten-year disqualification period was still running.
The Balochistan High Court found that Rind had filed a false affidavit at nomination, hiding his conviction for corruption. The court held that under Article 62(1)(d) of the Constitution, which requires a member of Parliament to be of good character and not known to violate Islamic injunctions, disqualification for corruption and dishonesty is permanent, not time-limited like the ten-year bar under the accountability law. Since he had admittedly lied under oath and been convicted of stealing public funds, he failed this permanent character test.
The court declared Rind unqualified to hold the office of Senator, ordered him to return all salary and benefits he had received, and directed the government to enforce this and consider prosecuting him for submitting a false nomination form. The case highlights that convicted persons cannot circumvent constitutional character requirements simply because a specific statutory disqualification period has expired.
