The State v. Nawabzada Shah Zain Bugti,

PLD 2012 221 · Balochistan High Court

This case involved a large-scale recovery of arms, ammunition, and vehicles allegedly seized jointly by police and the Frontier Corps from Nawabzada Shah Zain Bugti and several co-accused, following an FIR registered in Quetta in December 2010. During trial, the Additional Sessions Judge refused to let the prosecution produce these recovered items as evidence, reasoning that the record did not clearly show whether the articles had been properly taken into police custody, whether a seizure memo was prepared at the scene, whether the items were formally declared case property, and whether the legal requirements for recovery proceedings under Section 103 of the Criminal Procedure Code had been met.

The State challenged this refusal before the Balochistan High Court. The High Court found that the FIR did describe joint action by police and the Frontier Corps, that the Frontier Corps had retained physical custody of the seized items only because of their sheer volume, and that a seizure memo had indeed been prepared. ریاست نے اس فیصلے کو بلوچستان ہائی کورٹ میں چیلنج کیا۔ ہائی کورٹ نے پایا کہ ایف آئی آر
