Abdul Sattar v. the State,

PLD 2012 22 · Balochistan High Court

This case is about Abdul Sattar, who was convicted by a trial court in Dera Murad Jamali for the murder of Abdul Qadir and sentenced to life imprisonment. He appealed to the Balochistan High Court.

The prosecution's story was that Abdul Qadir was shot dead by four men, including the appellant, following a dispute over marriage—the deceased had married a woman who had divorced the appellant's brother. A co-accused was caught at the scene with a pistol and separately convicted, but the appellant was arrested and tried later.

The High Court found serious problems with the case against the appellant. The witnesses were all closely related to the deceased and hostile to the accused, and their testimony was not independently corroborated. No weapon was recovered from the appellant, and forensic evidence showed the bullets came from the gun recovered from the co-accused, not from any weapon linked to the appellant. One independent witness did not even mention the appellant's presence. The court also noted that the appellant's alleged absconding could not be held against him since he was never questioned about it during his trial, and flight alone does not prove guilt.

Because the prosecution failed to prove guilt beyond reasonable doubt, the High Court gave the appellant the benefit of the doubt, overturned his conviction, and ordered his release. The case highlights the importance of independent, credible evidence in murder trials, especially when witnesses have personal stakes in the outcome.
