PLD 2012 189 · Balochistan High Court

This case was about a decades-old land dispute in Loralai, Balochistan, involving several plots of agricultural land. The dispute traced back to a 1958 agreement in which the defendants' predecessor sold land to the plaintiffs' predecessor for a set price, part of which was paid upfront with the rest due in installments. The defendants argued the buyer failed to pay the remaining installments, so the agreement was cancelled and the land reverted to them. The plaintiffs, however, claimed ownership and possession, alleging the defendants had illegally interfered with their land by digging wells and installing a transformer. Lower courts had ruled in favor of the plaintiffs, and after an earlier appeal, the Supreme Court sent the case back to the High Court for a fresh, more thorough hearing on all the issues raised.

The Balochistan High Court examined several legal points: how much weight should be given to original land-revenue records (very strong evidentiary weight, hard to overturn), whether time was strictly essential in property contracts (not necessarily, especially where substantial performance already occurred), and rules about proving the execution of documents through witnesses. These principles guided how the court evaluated the competing claims of ownership and the validity of the 1958 agreement.

The case matters because it clarifies important evidentiary and contract-law principles applicable to long-running property disputes in Pakistan, particularly regarding revenue records and specific performance timelines.
