Shah Jahan and another V. The State,
PLD 2012 179 · Balochistan High Court
This case involved two men, Nasrullah and Shah Jahan, convicted by a Sessions Court in Mastung for murdering Abdul Waheed and sentenced to life imprisonment plus compensation. Both appealed to the Balochistan High Court.
The prosecution's case rested largely on circumstantial evidence: a witness had seen the deceased last in the company of one accused, and during police interrogation that accused led officers to a well where the victim's body was recovered after he admitted killing him with a knife. Medical evidence supported the cause of death.
The High Court examined the two appellants differently. For the accused who was seen with the deceased before his disappearance and who led police to the body, the Court held that this chain of circumstances - last-seen evidence, recovery of the body on his pointing it out, and medical evidence - was strong enough to prove guilt beyond doubt. His conviction was upheld.
For the second accused (co-accused), the only evidence was his own statement implicating himself, made during interrogation. The Court ruled this amounted to an inadmissible confession under the law of evidence, since it did not lead to discovery of any new fact - the location was already known to police. With no independent evidence connecting him to the crime, he was given the benefit of the doubt and acquitted.
The judgment illustrates how courts evaluate circumstantial evidence and confessions, and how the same set of facts can lead to different outcomes for different accused persons.
