Nasrullah alias Nasro and another V. The State and another,

PLD 2012 164 · Balochistan High Court

This case involved a man, Nasrullah alias Nasro, sentenced to death for murdering his wife, Hameeda Bibi, by shooting her in Loralai in 2010. His conviction under section 302(b) of the Pakistan Penal Code was appealed to the Balochistan High Court, which also had to confirm or set aside the death sentence referred by the Sessions Judge.

Two eyewitnesses, relatives of the deceased, testified to seeing the murder. The defense argued they were "interested witnesses" due to their family connection and pointed to some inconsistencies with medical evidence and the exact location of the crime scene. The court rejected these arguments, holding that mere relationship to the victim does not make a witness unreliable unless there is actual hostility toward the accused. It found the witnesses' accounts credible and well-supported by other evidence, including the accused's pistol being recovered based on his own disclosure, a positive ballistic report matching the weapon, and the fact that the accused had fled and remained absconding for two months without any reasonable explanation, which the court treated as evidence pointing to guilt.

The case reinforces principles about evaluating witness credibility and the weight given to absconding as corroborative evid
