Syed Saeed Rehman v. Muhammad Azhar Jamal,

PLD 2012 151 · Balochistan High Court

This case involved a money recovery suit. A creditor (Muhammad Azhar Jamal) had won a decree against a debtor (Syed Saeed Rehman) for Rs.26 lacs. When the debtor failed to pay, he was sent to civil prison. He then appealed, and the High Court released him from prison on condition that he provide sureties and not leave the court's jurisdiction or dispose of property until sureties worth Rs.26 lacs were furnished. Two individuals agreed to stand as sureties, each bound for Rs.13 lacs, on the condition that they would produce the debtor before the court whenever required.

The debtor later failed to appear both before the executing court and during his appeal hearing. The creditor then asked the court to forfeit the sureties and recover the entire decretal amount directly from the two guarantors.

The High Court examined Section 145 of the Civil Procedure Code, which allows a decree to be enforced against a surety, but only to the extent that the surety personally agreed to be liable. Reviewing the actual wording of the surety bonds, the judge found that the two men had only promised to produce the debtor in court, not to pay the decretal amount themselves. Therefore, the court could not hold them liable for the Rs.26 lacs debt. The appeal itself was dismissed for non-prosecution since the debtor never showed up. This case clarifies that sureties can only be held liable strictly according to the specific terms they agreed to, not for obligations beyond what they promised.
