Haji Nizamuddin v. Haji Payo Din,

PLD 2012 146 · Balochistan High Court

This case involved a dispute over ownership of a shop in Zhob, Balochistan. The petitioners (Haji Nizamuddin and others) filed a civil suit claiming the shop was jointly owned property and sought a declaration of their ownership share along with possession after partition. The respondent (Haji Payo Din) denied this, claiming exclusive ownership through an official allotment document (PATTA) from 1980.

The trial court and the appellate court both rejected the petitioners' suit, reasoning that the question of ownership had already been settled earlier by the Rent Controller during separate eviction proceedings, and that this earlier decision barred the new suit under the principle of res judicata (meaning the same issue cannot be litigated twice).

The Balochistan High Court disagreed and set aside both lower court orders. It held that a Rent Controller, acting under rent laws, only has jurisdiction to decide the relationship between landlord and tenant—not true ownership of property. The term landlord in rent law can include someone merely authorized to collect rent, not necessarily the actual owner. Since ownership is a substantive property right, only a regular civil court can determine it, through a full trial with evidence. The lower courts had wrongly decided the ownership question without even framing proper issues or recording evidence.

The case was sent back to the trial court to be decided properly, with issues framed and evidence taken. This judgment clarifies the limited authority of Rent Controllers and protects parties' rights to have ownership disputes fully tried in ordinary courts.
