Muhammad Ishaque v. Mst. Aniqa Batool,

PLD 2012 133 · Balochistan High Court

Muhammad Ishaq approached the Balochistan High Court after losing in the trial court and on appeal against Mst. Aniqa Batool, who had sued him and another person to have a supposed marriage deed and affidavit dated 14 August 1998 declared forged and cancelled. Aniqa claimed that Ishaq, who had been tutoring her, obtained her signature and thumb impression on documents by pretending they were needed for publication in an Urdu magazine, then fraudulently converted them into a marriage deed with the help of a co-defendant who falsely attested it, to later use against her and her family.

Ishaq argued the civil court had no jurisdiction, insisting such matters belonged exclusively to the Family Court, and also challenged the evidence relied upon, including uncertified photocopies of the disputed documents.

The High Court rejected the jurisdiction argument. It held that under Muslim law and the Muslim Family Laws Ordinance, a valid marriage between Muslims can only be proven through a proper Nikahnama, which must be registered. Since the disputed documents were merely an alleged agreement to marry and did not establish an actual, valid marriage, they could not be treated as a Nikahnama. Therefore, disputes about such documents fall under the jurisdiction of civil courts, not Family Courts.

This ruling clarifies the boundary between civil and family court jurisdiction, confirming that only genuine Nikahnama-related marriage disputes go to Family Courts, while questions about fraudulent or fabricated
