Samiullah V. The State,

PLD 2012 122 · Balochistan High Court

This case concerns a man named Samiullah who was convicted for drug trafficking under Pakistan's Control of Narcotic Substances Act, 1997. He was stopped at a checkpoint in Quetta while driving a car, and police found 40 kilograms of hashish hidden behind the rear seat. He was arrested and later convicted by a Special Judge, sentenced to life imprisonment and a fine.

On appeal, his lawyer argued the prosecution's evidence was contradictory and unreliable, that no private witnesses were involved in the recovery (as normally required under Section 103 of the Criminal Procedure Code), and that the defence evidence was more credible.

The Balochistan High Court rejected these arguments and upheld the conviction. It clarified an important legal point: while Section 29 of the Act creates a presumption of guilt once the prosecution proves recovery of narcotics, this does not remove the prosecution's basic duty to first prove its case beyond reasonable doubt. The presumption only shifts the burden to the accused after that initial proof is established.

The court also held that Section 103 Cr.P.C. (requiring independent witnesses during searches) does not apply to narcotics cases, so police testimony alone can be sufficient if credible. Since Samiullah was driving the car and controlled it, he was deemed to be in conscious possession of the drugs found inside. Finding the police account credible and the defence story implausible, the court dismissed the appeal and upheld his conviction and sentence.
