Abdul Wahid V. The State,
PLD 2012 104 · Balochistan High Court
This case involved the murder of Hussain Bakhsh, who was shot and killed while sleeping at home with his father in Khuzdar, Balochistan, in August 2007. The trial court convicted Abdul Wahid of murder under section 302(b) of the Pakistan Penal Code and sentenced him to death, while acquitting three co-accused for lack of evidence. Wahid appealed, and the case also came before the Balochistan High Court as a mandatory Murder Reference for confirmation of the death sentence.
The High Court overturned the conviction and acquitted Wahid, giving him the benefit of the doubt. The judges found serious weaknesses in the prosecution's case: witnesses admitted there was no electric light, torchlight, or moonlight at the scene, making it essentially impossible to actually identify the attacker in the dark, yet they still claimed to recognize him. The original police report (FIR) did not even name Wahid as a suspect, and he appears to have been implicated later based on a prior family feud rather than solid evidence. There were also major contradictions regarding how the alleged murder weapon was recovered, undermining the ballistic evidence, and the medical evidence could not independently identify the killer.
The court emphasized that in serious criminal cases, especially those carrying the death penalty, guilt must be proven beyond reasonable doubt, and any genuine doubt must favor the accused. This case illustrates how eyewitness identification claims can collapse under scrutiny when basic conditions like visibility are not credible, safeguarding
