Muhammad Afzal v. the State,

PLD 2011 Quetta 76 · Balochistan High Court

This is a criminal murder appeal decided by the Balochistan High Court. Muhammad Afzal was convicted by a Sessions Judge for the murder of two people, Adam Khan and his guest Bakhsh Ali, who were shot with a Kalashnikov rifle. He was sentenced to death under section 302(b) of the Pakistan Penal Code. He appealed from jail, and the case was heard alongside the mandatory reference sent by the trial court to confirm or overturn the death sentence.

The prosecution's case rested on eyewitnesses present at the scene, supported by medical evidence, an extra-judicial confession the accused reportedly made to another witness while seeking shelter, and the recovery of the Kalashnikov used in the crime, confirmed by a firearms expert's report. The High Court found the eyewitness accounts credible and consistent, noting that minor discrepancies from cross-examination did not undermine their reliability, especially since the witnesses were household members naturally present at the scene.

The court upheld Afzal's conviction, agreeing that the evidence clearly established his guilt. However, it reduced his death sentence to life imprisonment, reasoning that the killings did not appear to be planned or premeditated in advance.

This case illustrates how Pakistani courts evaluate eyewitness testimony against corroborating forensic and circumstantial evidence, and shows judicial discretion in sentencing—distinguishing between premeditated murder deserving death and spontaneous killings warranting life imprisonment instead.
