Atlas Cables (Pvt.) Ltd. v. Quetta Electric Supply Company Ltd,
PLD 2011 Quetta 67 · Balochistan High Court
Atlas Cables, a manufacturer of electric cables and conductors, challenged a letter from Quetta Electric Supply Company (QESCO) that blacklisted it for allegedly breaching supply contracts and failing to deliver materials on time. Atlas argued this violated its fundamental right to conduct lawful business under Article 18 of the Constitution, since the blacklisting effectively barred it from doing business with power companies, its main customers.
QESCO argued the petition should not be heard because Atlas had also filed a civil suit for damages. The court rejected this objection, noting the constitutional petition was filed first, was disclosed in the civil suit, and did not overlap with the relief sought there (the suit did not ask for a declaration about the blacklisting itself). So both cases could proceed separately.
On the main issue, the court examined QESCO's own "Registration Procedures," which allow blacklisting only for serious causes like fraud, forgery, or bribery—not ordinary contractual breaches—and only after approval from a "Registration Committee" and a hearing for the affected party. QESCO could not show any such committee approval or that Atlas was given a hearing.
The court ruled that QESCO violated its own procedures and Atlas's fundamental right to business under Article 18. It declared the blacklisting letter unlawful and void, ordered its recall to everyone it was circulated to, and allowed the petition. This case reinforces that government bodies must follow fair procedure and proper legal grounds before blacklisting businesses.
