Shah Muhammad v. State,

PLD 2011 Quetta 57. · Balochistan High Court

This case is about a criminal appeal filed by Shah Muhammad, who had been convicted by a Sessions Judge in Loralai for helping another person escape from police custody, an offence under Section 225 of the Pakistan Penal Code. He was sentenced to one year of rigorous imprisonment.

The background was that a man named Ahmed Din had allegedly been arrested by police, and Shah Muhammad and others were accused of using force to free him, in the process supposedly firing on police and damaging a police vehicle. Shah Muhammad appealed his conviction to the Balochistan High Court.

The High Court found major problems with the prosecution's case. Most importantly, the police never proved that Ahmed Din's arrest or detention was actually lawful, since no officer from the police station that supposedly first arrested him testified. The court explained that Section 225 only applies when someone helps a person escape from lawful custody, meaning custody backed by a valid warrant or legal authority. Since lawfulness was never proven, no offence under this section could stand even if the rescue happened.

The court also noted the FIR was filed eight hours late without explanation, contradictions between witnesses, and failure to produce the supposedly damaged police vehicle, all suggesting the story was fabricated and the accused falsely implicated because he was the escaped man's brother.

As a result, the High Court set aside the conviction and acquitted Shah Muhammad, reinforcing that proving lawful custody is essential before someone can be punished for helping another escape from it.
