Chakar Khan v. Azad Khan,

PLD 2011 Quetta 26. · Balochistan High Court

This case involved a land dispute between two families over agricultural property in Sibi, Balochistan. The respondents claimed they were the rightful owners and that the petitioners' predecessor had been given possession of the land only as a tenant under a cultivation arrangement, but had failed to pay the agreed share of produce. They sued for declaration of ownership and possession. The petitioners denied any landlord-tenant relationship and claimed ownership through long possession. During the case, the petitioners also filed a separate suit to cancel mutation entries recording the land in the respondents' names. The two suits were consolidated and tried together by the trial court, which ruled in favor of the petitioners. On appeal, the district judge reversed both decisions, ruling for the respondents instead.

The petitioners challenged this in the High Court, arguing that a single appeal could not validly cover two separate judgments and decrees, and that their suit was wrongly deemed time-barred.

The High Court rejected these arguments. It held that once two suits are consolidated and decided through one common judgment, they lose independent existence, so a single appeal is valid and proper. The court also held that mere long possession does not create ownership, and since the petitioners denied the respondents' title, the respondents were entitled to sue in civil court rather than revenue court. The revision petition was dismissed, meaning the appellate court's decision favoring the respondents stood. The case clarifies procedural rules on consolidated suits and reaffirms that possession alone cannot defeat ownership rights.
