Muhammad Khalil v. Executive District Officer,

PLD 2011 Quetta 21. · Balochistan High Court

This case is about whether a district revenue officer could cancel domicile certificates that had already been issued to two petitioners, a father who was a police constable and his son.

The father had worked as a constable in Pishin since 1984 but only applied for a domicile certificate from Pishin in 2006. His son later got a separate certificate issued in his own name in 2008. After someone raised an objection, the Executive District Officer investigated and cancelled both certificates in 2009, finding that the family actually lived permanently in Dera Ghazi Khan and had only used a Pishin address to gain benefits meant for people from that backward district.

The petitioners argued that once a domicile certificate is granted, it creates a right that cannot be taken away. The Balochistan High Court disagreed. It explained that a domicile certificate is only prima facie proof of where someone permanently lives, and authorities can investigate and cancel it later if it was obtained through fraud, misrepresentation, or concealment of facts. Since the evidence showed the petitioners had concealed their true permanent residence and misrepresented facts to get the certificates, the cancellation was lawful.

The court dismissed the petition, finding no illegality in the officer's decision. The case matters because it clarifies that domicile certificates are not permanent, unchallengeable rights and can be revoked if obtained dishonestly, protecting the certificates' purpose of accurately reflecting genuine residence.
