Abdul Hameed v. Judicial Magistrate,

PLD 2011 Quetta 11 · Balochistan High Court

This case is about illegal fishing off Pakistan's Balochistan coast. Fishermen aboard a trawler were caught fishing within four nautical miles of the shore using a prohibited fine-mesh net known as "gujja," which is banned because it harms marine life and fish populations. They were charged and pleaded guilty. The trial magistrate fined them Rs.15,000 and returned their trawler and equipment, but kept the banned fishing nets confiscated by the state. The fishermen challenged this, arguing the nets should also be returned, and their appeal to the Additional Sessions Judge was rejected. They then approached the Balochistan High Court, asking it to use its special inherent powers to overturn the confiscation.

The Chief Justice dismissed the petition. He held that confiscating equipment used for illegal fishing is not just permissible but mandatory under the relevant fisheries law, and that courts also have general power under the Criminal Procedure Code to order destruction or confiscation of items used to commit a crime. The judge noted that the accused had already received a lenient punishment (only a fine, no imprisonment) and had gotten their valuable trawler back, so there was no unfairness justifying court intervention. He went further, ordering that the confiscated nets be destroyed entirely, so they could never be reused for illegal fishing.

The case matters because it reinforces that courts can order destruction of tools used in environmentally harmful crimes, even without explicit legal provisions, to protect natural resources.
