Pakistan Petroleum Ltd. v. Dir. General Mines,

PLD 2011 Quetta 1 · Balochistan High Court

This case involved Pakistan Petroleum Limited (PPL), which held a prospecting license and later a 20-year mining lease for iron ore in Chagai district, Balochistan. The government's Director-General of Mines issued PPL a show-cause notice giving it 30 days to explain why its unused mining leases should not be cancelled. However, before that 30-day period even expired, the authorities carved out a large chunk of PPL's leased area and granted a prospecting license for it to another company, Messrs Shahnawaz Pumice, and then permitted that company to begin mining operations there.

PPL challenged this before the Balochistan High Court, arguing it was denied a fair hearing and its rights under the lease were violated. The Court agreed. It found that the authorities acted with bias, favoritism, and possible mala fide intent, breaching the principle of audi alteram partem (the right to be heard) by punishing PPL before its response deadline had even passed. The Court also noted that PPL's appeal against these actions had been left pending indefinitely by the appellate authority, who failed to exercise his duty under the mining rules.
