Muhammad Khan v. State,

PLD 2011 Qta 18 · Balochistan High Court

This case involved Muhammad Khan, who was stopped by Frontier Corps personnel near Quetta in 2009 and found in possession of a pistol, hand grenades, explosive material, a detonator, and other items. He was charged under laws dealing with illegal weapons and explosives, including the Anti-Terrorism Act. The trial court convicted him under the Arms Ordinance for unlawfully possessing an unlicensed pistol, sentencing him to three years imprisonment and a fine.

He appealed, arguing that the pistol recovered from him was not properly sealed at the scene and was never sent to a ballistics expert to confirm whether it actually worked. His lawyer suggested this undermined the prosecution's case.

The Balochistan High Court rejected these arguments. It noted that the defence never actually challenged whether the pistol was functional when witnesses testified, and more importantly, the law does not require a weapon to be in working condition for its possession to be illegal—simply having an unlicensed weapon without proper authorization is the offence. The court held that failing to seal the weapon or send it for expert testing were mere procedural lapses by the investigating officer, not serious enough to undermine the conviction.

The court dismissed the appeal and upheld the original judgment, reinforcing the principle that technical or administrative omissions during investigation do not automatically invalidate a conviction when the core evidence of illegal possession stands unrefuted.
