Syed Muhammad Jawad  V.  Abdul Nabi,

PLD 2011 62 · Balochistan High Court

This case, decided by the Balochistan High Court in 2011, involved a dispute over ownership and possession of a truck. The petitioner had originally sued for a declaration that he owned the truck, claiming he received it in a transaction involving his residential house, while the respondent argued the petitioner owed him a large sum of money and had failed to honor their agreement. The trial court initially ruled in the petitioner's favor, and he took possession of the truck. This decision was upheld on appeal, but the High Court later remanded the case back to the trial court due to a court-fee deficiency, without deciding the merits.

After remand, the trial court ordered the petitioner to return the truck or pay its value, and the petitioner's suit was eventually dismissed for non-prosecution. The respondent then sought restitution under Section 144 of the Civil Procedure Code, arguing he should get back the truck since the earlier judgments favoring the petitioner had been set aside. The lower courts agreed with him.

The High Court disagreed and set aside these orders. It held that restitution under Section 144 only benefits someone who lawfully lost something due to a court decree that was later reversed. Since the respondent had originally taken the truck illegally by force through the Truck Association rather than through lawful means, he was not entitled to restitution. This case clarifies that the law protects lawful possession gained through court orders, not those who take matters into their own hands.
