Mst. Shahzadi v. The State,
PLD 2011 32 · Balochistan High Court
Mst. Shahzadi's husband died, and she alleged that her stepsons forced her out of her home and took her cash, jewelry, vehicles, weapons, and other belongings. When she reported this to the police, they refused to register a First Information Report (FIR). She then approached the Sessions Judge, acting as Justice of Peace under section 22-A of the Criminal Procedure Code, asking that the case be formally registered and investigated. Instead of ordering registration of the FIR, the Justice of Peace directed the police to first conduct an inquiry under section 157(2) of the Code, and only register the FIR if that inquiry showed a crime had occurred.
The Balochistan High Court found this approach wrong. It held that the law does not allow for an inquiry to be conducted before an FIR is registered. Once information disclosing a cognizable offence (a serious crime the police can investigate without court permission) is received, the police must first record it as an FIR, and only afterward carry out an investigation and report to the court. By ordering an inquiry before registration, the Justice of Peace misunderstood and misapplied his powers under section 22-A.
The court set aside the earlier order and directed the police to register the FIR immediately and proceed with the investigation according to law. The case reinforces that citizens reporting cognizable crimes have a legal right to prompt FIR registration, without police or courts imposing extra preliminary screening.
