Ahmad Karam v. Director of Education,
PLD 2010 Quetta 73 · Balochistan High Court
This case involved three petitioners who worked, or claimed to work, as Junior Arabic Teachers or Moallim-ul-Quran under the Education Department in Balochistan. They asked the High Court to declare that they were legitimately serving in the department, to let them perform their duties, and to order release of their withheld salaries.
The court found that the same dispute had already been raised in an earlier constitutional petition filed in 2007, which the petitioners themselves withdrew in January 2008 after seeing the government's response. Later, they filed a contempt application claiming the court's earlier order was being violated, and when that too was disposed of, they were told they could approach the appropriate forum for relief. They then filed this fresh petition, treating the contempt order as giving them a new right to litigate the same issue.
The Chief Justice rejected this approach, holding that a contempt order cannot revive or create new rights once the original petition was voluntarily withdrawn. Under the Civil Procedure Code, once a case is withdrawn, the person is barred from filing a fresh case on the same subject matter unless the court granted specific permission to do so, which had not happened here.
Additionally, the petitioners failed to prove their academic degrees came from a recognized institution, a point the government had specifically disputed.
For these reasons, the petition was dismissed. The case illustrates the legal principle that withdrawing a case has consequences, and litigants cannot use contempt proceedings to sidestep that bar and relitigate the same grievance.
