Muhammad Rashid v. Irshad Begum,
PLD 2010 Quetta 70 · Balochistan High Court
This case involved a dispute over a small shop and room in Quetta that had belonged to a deceased man, Muhammad Amiruddin. Earlier, the High Court had ruled that no one could occupy the property until the deceased's legal heirs were found or a court determined ownership. Muhammad Rashid filed a contempt application claiming that Irshad Begum, the deceased's divorced wife, had illegally taken possession of the property in violation of that earlier ruling, arguing she was not a legal heir since she was divorced before his death.
Irshad Begum's lawyer argued Rashid had no standing or personal interest in the property and wasn't a legal heir either. He noted she was an elderly woman caring for a mentally disabled son, and that she would vacate if a genuine legal heir came forward. The government's lawyer also opposed the contempt action, noting the property was unclaimed and the state technically owned such property, but had no objection to letting the woman and her son stay temporarily.
The court declined to punish her for contempt, given her circumstances and her lawyer's formal undertaking not to sell or transfer the property. It ruled she could keep living there until a legitimate heir appeared, provided she didn't dispose of the property, and that if she left, the state would take control of it. The court emphasized that supporting a vulnerable elderly woman and her disabled son served the public good.
