Aurangzaib Shah v. State,

PLD 2010 Quetta 7 · Balochistan High Court

This case is about three men convicted in connection with a robbery and separate weapons charges arising from the same incident in Mastung, Balochistan in 2006. All three had been convicted under section 395 of the Pakistan Penal Code (robbery) with sentences reduced on appeal to the Federal Shariat Court to five years each. They were also separately convicted under section 13-E of the Arms Ordinance, 1965 for illegal weapons recovered from them, receiving additional sentences of two to three years.

The trial court had ordered these sentences to run consecutively, meaning one after the other. The appellants argued this violated the law, since section 13-E of the Arms Ordinance caps punishment at seven years, but two of them would effectively serve eight years if their robbery and weapons sentences were added together. They relied on section 35 of the Criminal Procedure Code and section 71 of the Penal Code, which limit punishment in such situations and generally favor concurrent sentencing when offenses arise from the same transaction.

The Balochistan High Court, led by Chief Justice Qazi Faez Isa, agreed. It found that consecutive sentencing for two of the appellants exceeded the legal maximum. Even though the third appellant's combined sentence did not exceed the cap, the court noted it would be unfair for him to serve longer than the other two, so it extended the same relief to him.

The court ordered all three men's sentences to run concurrently rather than consecutively, ensuring consistent and lawful punishment across similar cases arising from one incident.
