Giran Naz v. State,

PLD 2010 Quetta 61 · Balochistan High Court

This case involved a woman who took shelter in a government-run women's shelter (Dar-ul-Aman) in Quetta because her brother opposed her wish to marry the man of her choice. She and her intended husband tried to get a court marriage arranged, but a Judicial Magistrate and later a Sessions Judge kept refusing, insisting instead that the matter be settled with her family first and that she be handed over to her relatives' custody as a precondition to marriage.

The couple then approached the Balochistan High Court, asking it to direct the shelter's superintendent to arrange their marriage and release the woman as the man's wife. The High Court ruled in their favor. It held that under Article 4 of the Constitution, no one can be stopped from doing something the law does not prohibit, and Pakistani law does not bar an adult woman from marrying an adult man she chooses. The court also invoked constitutional provisions protecting the institution of marriage and citing Islamic teachings on the sanctity and beauty of marriage. After personally confirming the woman was an adult who understood her decision, the judges found no lawful basis to block the marriage or make it conditional on family approval.

The court set aside the lower courts' orders, directed the shelter to arrange the marriage, and fixed a marriage dower (mehr) of Rs.100,000, given that the woman was an orphan. The case matters because it affirms that adult individuals, particularly women, have a constitutionally protected right to marry by their own choice, free from family or judicial interference.
