Khalo v. State & Abdul Qayyum v. State,

PLD 2010 Quetta 58. · Balochistan High Court

This case involved two men, Khalo and Abdul Qayyum, who were arrested at a graveyard in Quetta at night based on a tip-off from a police informant. Police found unlicensed pistols and cartridges on them, and they were charged with making preparation to commit dacoity (armed robbery) under sections 399, 400, and 401 of the Pakistan Penal Code. A trial court convicted them, sentencing each to seven years in prison plus a fine.

On appeal, the Balochistan High Court examined whether the prosecution had actually proven the legal requirements for the offence of preparing to commit dacoity, which requires showing both intention and concrete preparation. The court found that none of the prosecution witnesses gave any evidence about the accused's actual intentions, and there was no proof of any overt act suggesting they were preparing for a robbery. The case rested merely on the informant's tip and the fact that armed men were found in a graveyard at night. The court held that simply being present somewhere unusual at an unusual hour, even with an illegal weapon, does not by itself prove intent to commit dacoity, since no law restricts when or where people may move about.

Finding the prosecution's case highly doubtful, the court ruled that this doubt should have benefited the accused, something the trial court failed to do. The convictions were set aside and the men were acquitted, highlighting that vague suspicion and informant tips alone cannot substitute for concrete evidence of criminal intent.
