Soorat Khan v. Anti- Terrorism Court,
PLD 2010 Quetta 52 · Balochistan High Court
This case involved a father, Soorat Khan, whose son died after stepping on a landmine that had allegedly been planted to force employees of a government-run security force (Chamalung Security Force) to quit their jobs, and to discourage others from joining. An FIR was filed under explosives law, but the question arose over which court should try the case: an ordinary criminal court or the special Anti-Terrorism Court.
A trial judge initially decided the case did not qualify as terrorism and sent it back to be tried by an ordinary court. Soorat Khan challenged this decision before the Balochistan High Court.
The High Court examined the legal definition of terrorism under Section 6 of the Anti-Terrorism Act, 1997, which requires both a harmful act (like causing death using explosives) and an intent to coerce, intimidate, or create fear among the public or the government. The court found that using a landmine to pressure security force employees into quitting and to intimidate others from joining fit squarely within this definition, since it created public fear and disrupted normal life, even though there was no personal enmity involved.
The court also clarified that ordinary criminal procedure rules about classifying offenses did not apply to Anti-Terrorism cases. As a result, the High Court set aside the earlier order and directed the Anti-Terrorism Court to proceed with the trial itself. This case matters because it helps define what counts as "terrorism" under Pakistani law, particularly in cases involving intimidation of workers or public institutions rather than personal disputes.
