This case involved a dispute over a medical college admission in Balochistan. Noroz Khan applied for a seat reserved for District Gwadar at Bolan Medical College under the 2008-09 admission process. Although he ranked higher on the entrance test than another candidate who was ultimately admitted, the Selection Committee rejected his application because records showed he had held domicile certificates from two districts, Gwadar and Kech, at the same time. This violated Paragraph 32 of the college prospectus, which barred such candidates from reserved-seat admission unless specific conditions were met.
Khan argued he had gotten his Kech certificate cancelled before applying, leaving him with only the Gwadar certificate. The court found that even accepting this claim, admission could only be granted as a "special case" under the prospectus, which required three conditions: the extra certificate must have been cancelled at least two years before applying, the candidate must inform the Selection Committee of this at the time of admission, and the Committee retained discretion to allow it. Since Khan's cancellation had not occurred two years prior and he had not disclosed his prior dual certificates to the Committee, none of these conditions were satisfied.
The High Court ruled that the Selection Committee had acted lawfully in rejecting Khan's application and refused to interfere with its decision, dismissing the petition. This case illustrates how courts generally defer to institutional admission committees when they apply their own published rules correctly and fairly.
