Muhammad Afzal v. Secretary Forest,

PLD 2010 Quetta 24. · Balochistan High Court

This case concerned timber importers who brought wood from Afghanistan into Pakistan and paid customs duty to the Federal Government. When they moved the timber into Balochistan, the provincial Forest Department also charged them tax. The importers challenged this, arguing they were being taxed twice, which they claimed violated Article 163 of the Constitution, and also arguing that the Forest Act, 1927 had never been formally adopted by the Balochistan Government, so the Forest Department had no legal power to collect any tax.

The matter had a long history: a Balochistan High Court had earlier ruled in the importers favor, but the Supreme Court set that decision aside and sent the case back for fresh examination of whether prior permission from forest authorities was needed to move timber through Balochistan, and whether the place of loading mattered.

On reconsideration, the High Court held that the Central Laws (Statute Reforms) Ordinance, 1960 had extended the Forest Act, 1927 to the whole of Pakistan, including Balochistan. Under Section 39 of that Act, the provincial government was legally authorized to levy duty on timber and forest produce through official notification. Since the Forest Department had acted within this legal authority, its tax collection was valid and not illegal. The court dismissed the petitions and ordered the importers to release the disputed tax amounts, along with accrued profit or interest, to the Forest Department. This clarified that provincial forest taxes on imported timber were legally valid even after federal customs duty had been paid.
