Ghulam Hussain v. Additional Sessions Judge,

PLD 2010 Quetta 21 · Balochistan High Court

This case involved a man convicted for gambling under Balochistan's Prevention of Gambling Ordinance, 1978. Police had raided his house based on a tip that gambling was occurring there, and he was subsequently convicted by a Judicial Magistrate and sentenced to prison and a fine. An appellate court upheld the conviction but reduced the fine. The man then challenged both decisions before the Balochistan High Court.

The key legal issue was that the law required raids on private homes for suspected gambling to be conducted by a Magistrate, who must first inquire into the matter before authorizing entry. Police alone had no power to conduct such raids or initiate the case; their role was only to assist a Magistrate. In this case, no Magistrate had investigated the matter or been present during the raid, meaning the mandatory legal procedure was completely bypassed.

The Chief Justice ruled that this failure was not a minor technicality but a serious violation, since the privacy of one's home is a fundamental right protected under Article 14 of the Constitution. The judgment traced this right to religious and ethical traditions, citing Quranic verses and sayings of the Prophet Muhammad about respecting the sanctity of homes and not intruding without permission.

Because the raid violated mandatory legal safeguards, any evidence gathered during it was ruled invalid and inadmissible. As a result, the court set aside both lower court judgments and acquitted the accused, emphasizing that strict compliance with legal procedures is essential whenever the state intrudes into someone's private residence
